Capable Texas Estate Planning Lawyer

Many people put off creating an estate plan because they do not like to think about death. However, an estate plan is more than a document that determines how your assets will be distributed after you die. It also can be used to protect your assets and your family members while you are living.

Wills And Trusts

A will tells a probate court how you wish to have your assets distributed upon your death. It can also be used to name a guardian for minor children.

There are many different kinds of trusts. A testamentary trust is most common. A testamentary trust is a trust created in your will and into which your property is placed after death.

A health care power of attorney allows you to name a trusted person to make health care and financial decisions for you if you are incapacitated. Without a power of attorney, your loved ones would be forced to go through the cost and delay of a guardianship proceeding if you became incapacitated and were not able to communicate for yourself.

A directive to physicians (also called a living will) or health care proxy is a document that every person should have, young or old. It allows you to tell doctors and family members, whether you want to have artificial life support such as feeding tubes if you are in a terminal condition with no hope of making a recovery.
