In order to ensure the procedural integrity of the divorce mediation process, mediators cannot give legal advice; rather, they must remain neutral with regard to the parties involved. When legal issues arise, the parties can consult with their attorney. Mediators typically meet with each party and their attorney separately in order to identify important issues regarding the division of marital assets and marital debt, child custody and parenting time. Afterward, the mediator will help frame the issues in order to underscore what is in the best interests of both parties and to keep discussions on track. Once the parties begin negotiations, the mediator goes back and forth between the parties to present proposed terms and keep discussions moving forward.
