There are many reasons why you may want to have a prenuptial agreement. Prenuptial or premarital agreements are legal mechanisms for identifying separate property to preserve its separate character and prevent a community economic contributions claim from attaching to the separate property during marriage. These agreements can also stipulate that assets or earnings accumulated after marriage are separate property rather than community property. While premarital agreements are used most often in second marriages, anyone who has significant assets should consider a prenuptial agreement.

It's important that your lawyer draft the prenuptial or postnuptial agreement properly. Although marital property agreements are favored by the law, they can e voided if they are not voluntarily or (in some cases) if they are unconscionable.

Postnuptial agreements are often used after marriage to ratify a prenuptial agreement. A postnuptial agreement can also be used to insulate a spouse from debts incurred by the other party.
